Acceptance of Terms

By accessing or using our website, contacting us for services, or entering into a service agreement with JS ProFinish, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Description of Services

JS ProFinish provides basement finishing and general contracting services in Northern Utah, including but not limited to Davis County and Weber County. Our services may include design consultation, project planning, construction, carpentry, drywall installation, painting, and other related services as agreed upon in a separate written contract.

Service Agreements

All construction services require a separate written contract between you and JS ProFinish. These Terms do not replace or supersede any terms contained in such contract. In the event of any conflict between these Terms and a separate written agreement, the terms of the separate written agreement shall prevail.

Project Specifications and Changes

All project specifications, including scope of work, materials, and timeline, will be detailed in your written contract. Any changes to the project scope, materials, or timeline must be agreed upon in writing and may result in additional costs and timeline adjustments.

• Change Orders: Any changes requested after the contract is signed must be documented in a written change order, signed by both parties, and may result in additional costs and timeline extensions.
• Unforeseen Conditions: Unforeseen conditions discovered during construction (such as water damage, mold, electrical issues, etc.) may require additional work not included in the original contract and may result in additional costs.

Payment Terms

Payment terms and schedules will be detailed in your written contract. Typical payment schedules include:

• An initial deposit upon signing the contract
• Progress payments at predetermined milestones
• Final payment upon completion of the project

Failure to make payments according to the agreed-upon schedule may result in work stoppage, late fees, and other consequences as outlined in your contract.

Warranties and Guarantees

JS ProFinish provides a workmanship warranty on all completed projects as specified in your contract. This warranty covers defects in workmanship but does not cover damage caused by normal wear and tear, improper maintenance, or alterations made by others.

Manufacturer warranties for materials and fixtures will be passed through to the customer. These warranties vary by manufacturer and product and are separate from our workmanship warranty.

Limitation of Liability

To the maximum extent permitted by law, JS ProFinish shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our website or services
• Any conduct or content of any third party on our website
• Any unauthorized access, use, or alteration of your transmissions or content

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of JS ProFinish or its content suppliers and is protected by United States and international copyright laws.

JS ProFinish grants you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. This license does not include any resale or commercial use of our website or its contents.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Utah.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our website or services after any changes indicates your acceptance of the modified Terms.
